What is The Constitution?

The constitution is the underlying framework of our country. It is the basis for all our citizen’s rights and the laws and policies of our country. It describes the branches and framework of the government.

Preamble

We, as the citizens of Pafüt Meefneps, in times of crisis and necessity to put down to paper, this constitution, to serve as the basis for a perfect country, away from earth to preserve the species of humans and create a society to preserve the human species and secure peace, welfare, and security for all inhabitants.

ARTICLE I: Layout and Powers of the Branches of the Government

Section I: Layout

The government shall have 2 branches. The Legislative Branch and the Judicial Branch. The Legislative Branch controls the creation, removal, and rewriting of laws and policies. Meanwhile, the Judicial Branch controls law enforcement to ensure the laws are being followed and provides courts and juries when a crime is committed. In addition to the two branches, there is a third power: the Prime. The Prime acts mostly as a figurehead, although they are in charge of diplomacy and they are the main way the government interacts with the country.

Section II: Powers of the Legislative Branch

The Legislative Branch is composed of the Assembly. The Assembly is made of one member per 10000 people, rounded up. The assembly also votes to approve Law and Policy changes for General Voting. The members of the assembly are not allowed to give law or policy changes to the assembly, and the members of the assembly must not know who made the request.

Section III: Powers of the Judicial Branch

The Judicial Branch of the government runs all trials and maintains 50 judges at all times. It also maintains all law enforcement officers. It cannot change legislation on its own, but judges are the only people holding a government position that can suggest law or policy changes to the Legislative Branch.

Section IV: Powers of the Prime

The Prime holds control over diplomacy with foreign powers. However, as of current, there are no other civilizations on Pafut Meefneps, so they act as the ambassador to the Greater Universe Committee. The Prime will serve for 5 years. However, the Prime can not serve for more than 5 terms.

ARTICLE II: Protocols for the Legislative Branch

Section I: Law and Policy Changes

A law or policy change will be proposed by a civilian. It cannot be given by persons holding a government office. When a change is proposed to the assembly, they vote on whether or not it is a worthwhile change that should be considered by the public. If at least ½ of the assembly votes in favor of the change then it proceeds to general voting. Otherwise it is filed away. Either outcome is then communicated to the people. If the assembly gets a sum of at least 400,000 signatures to reconsider their verdict then the have a small pool of 500 voters. If at least ⅕ of them think it should go on to general voting, then it continues. Otherwise it is filed away in the archives of the government. Once it goes to general voting, it requires a ⅔ majority to get signed in by the Prime and put into law.

Section II: Electing new Assembly Members

When it comes time elect new assembly members all canditatory essays are given to the assembly. After select five for each district of 10,000 people, they interview them and choose new ones if need be. Once all the candidates are selected, each district ranked choice votes on their new assembly member.

Section III: Removing and Replacing Assembly Members

Removing an Assembly member proceeds just like a law or policy change. If the Assembly member is removed then the Assembly will elect a new assembly member normally, but for only one district.

ARTICLE III: Protocols for the Judicial Branch

Section I: Trials

There are two kinds of cases, Civil and Criminal. Civil cases are opened by civilians against civilians or the government. Criminal cases are opened by members or representatives of the government (such as tax collectors or law enforcement)

The Defendant gets to choose whether or not to have a jury in the trial. Each party has 2 week period to gather evidence for their case before the trial begins. Both parties have an inspectegator from law enforcement to aid their search. During that time, if a jury is needed, the members of the jury are selected. First, the Plaintiff will present their evidence to the court. The Defendant then gets a rebuttal before they present their evidence. After the Defendant presents their evidence to the court the Plaintiff gets a rebuttal. After the evidence has been presented, the court will make a decision.

Section II: Electing Judges

To appoint a Judge, the Judge must first send a Candidate Essay to the Assembly. The Assembly will then make a decision with the other current judges. However, they will only appoint a judge when a judge leaves their position. This creates a line of judges. Each judge will serve for life and there will be 50 judges at any one time.

Section III: Removing Judges

A judge may resign at any time if they feel like it however, they cannot become a judge again. Through a general vote of the public, the Legislative Branch can remove a judge. Similarly, if a judge is removed from office, then they cannot reapply.

ARTICLE IV: Protocols for The Prime

Section I: Electing the Prime

To elect a new Prime, all applicants must submit a Candidate Essay. The assembly then looks over the Essays and selects 10 main candidates. They then personally interview the ten candidates and revise the list of main candidates further if they seem unfit for serving as Prime. If a fact in their essay is proven to be false at this time, they are also impeached permanently, thus it is of utmost importance to fact-check one’s essay. After candidate validation, the Assembly creates a summary of each candidate’s essay, to be put on voting forms. The general public then votes with ranked-choice voting to decide the new Prime.

Section II: Imcheaching the Prime

When the Prime is impeached, they are either impeached permanently or temporarily. If they are impeached permanently, then they are unable to hold any office in the government. However, if they are simply impeached temporarily, they can hold a government office the next term. However, if they are impeached temporarily twice, then they are impeached permanently, and can no longer hold a government office.

ARTICLE V: Amendment Protocol

Section I: Adding and Removing Amendments

Amendment additions and removals are given to the Assembly by the public. However, judges from the Judicial Branch will work with the Assembly to consider the amendment. Other than this it proceeds just like a Law or Policy change.
